DBBD-AP: Duty to Report Arrest or Criminal Charges
This policy applies to all educators in the West Fargo Public School District, all individuals that volunteer their services to a school activity, independent contractors, and staff of independent contractors having direct and ongoing contact with learners. It applies at all times and in all places, not just during the school day. If there is any doubt about whether the policy applies in a situation, it should be assumed that it does.
Any individual covered by this policy who is arrested or charged with violating state or federal law must report the arrest or charge in writing to their building administrator or department director. This report must be made no later than the end of the first weekday following whichever occurs first: the arrest or the filing of charges.
Once an administrator receives this information, they will notify the director of human resources and the superintendent. These administrators will review the arrest or charge to determine whether it could cause harm to, or otherwise negatively impact, learners.
Failure to comply with this policy, or the nature of the offense itself, may result in disciplinary action. Such action can include consequences up to and including termination of employment or services.
